Protecting your personal data is a priority for Actimostra.

This Privacy Policy explains who we are, the purposes for which we process your personal data, how we process it, with whom we may share it, how long we retain it, and how you can contact us and exercise your rights.

Who are we?

Your personal data will be processed by Actimostra Lda., company registration number 504541072 (hereinafter referred to as "Actimostra").

Actimostra is the Data Controller for the purposes of the General Data Protection Regulation (GDPR).

Why do we process your personal data?

Actimostra may collect and process your personal data for the following purposes:

a) To comply with legal obligations to which Actimostra is subject, including reporting requirements to the Portuguese immigration authorities and for invoicing and tax purposes.

b) To perform the Temporary Tourist Accommodation Agreement or the Local Accommodation Management Agreement entered into with Actimostra, including payment processing, check-in and check-out management, guest management, security deposit processing, the provision of additional services such as housekeeping, airport transfers, breakfast or grocery services, the management of contractual obligations, and pre-contractual procedures.

c) To communicate with you by email or mobile communications regarding commercial information, digital platforms, Actimostra's marketing activities, contractual communications, promotional campaigns and responses to information requests.

d) To protect property and assets owned or managed by Actimostra, as well as for statistical analysis and business reporting purposes.

Failure to provide the personal data required for the purposes referred to in paragraphs (a) and (b) may prevent Actimostra from complying with its legal obligations and may therefore result in the termination of the Temporary Tourist Accommodation Agreement or the Local Accommodation Management Agreement without any entitlement to compensation. It may also prevent Actimostra from providing the contracted services where such failure is not attributable to Actimostra.

What personal data do we collect?

In the course of its business activities, Actimostra collects and processes the personal data necessary to provide the contracted services, respond to enquiries and manage pre-contractual relationships.

Such data may include, among others:

Identification details;
Contact information;
Banking details;
Payment card information.

What is the legal basis for processing your personal data?

The processing of your personal data is based on the performance of the Temporary Tourist Accommodation Agreement, the Local Accommodation Management Agreement, and the fulfilment of legal obligations imposed upon Actimostra, particularly those arising from legislation governing the entry, stay and departure of foreign nationals in Portugal, as well as applicable tax legislation (Article 6(1)(b) and (c) of the GDPR).

Personal data processed for the purposes described in paragraph (c) above is processed on the basis of your consent (Article 6(1)(a) GDPR).

Personal data processed for the purposes described in paragraph (d) above is processed on the basis of Actimostra's legitimate interests (Article 6(1)(f) GDPR).

How long do we keep your personal data?

Without prejudice to any legal, regulatory or judicial requirements, your personal data will only be retained for the minimum period necessary to fulfil the purposes for which it was collected or subsequently processed.

Who may we share your personal data with?

Actimostra may need to share some of your personal data with the following recipients:

Companies or organisations affiliated with Actimostra, provided that they apply an equivalent level of personal data protection.
Public authorities to whom Actimostra is legally required to disclose information, including the Portuguese Immigration Authorities and the Portuguese Tax Authority.
Service providers acting as data processors under written agreements and solely for the purpose of providing technical or operational support to Actimostra. These may include website hosting providers, email marketing service providers, housekeeping companies, law firms, accounting firms and insurance companies.
Competent judicial, regulatory or supervisory authorities where disclosure is required by law or necessary for legal proceedings, technical investigations or security purposes.

Are my personal data transferred outside the European Union?

Personal data collected by Actimostra will not normally be transferred outside the European Union.

Exceptionally, and where legally permitted, Actimostra may transfer personal data outside the European Union for purposes including data hosting, technical processing services, cloud storage, backup and disaster recovery services, or software development.

Whenever such transfers occur, Actimostra will ensure that appropriate safeguards are implemented in accordance with the GDPR and will not transfer personal data to countries that do not provide an adequate level of data protection unless permitted under applicable law.

What are my rights?

Under the GDPR, you may at any time exercise the following rights:

Right of access;
Right to rectification;
Right to erasure ("right to be forgotten");
Right to restriction of processing;
Right to object to processing;
Right to data portability.

Where requests are manifestly unfounded or excessive, particularly because they are repetitive, Actimostra may charge a reasonable administrative fee or refuse to act on the request, as permitted under Article 12 of the GDPR.

Where processing is based on your consent, you have the right to withdraw that consent at any time.

Withdrawal of consent shall not affect the lawfulness of any processing carried out before its withdrawal, nor any processing based on another lawful basis, such as contractual necessity or legal obligation.

You also have the right to lodge a complaint with the competent Data Protection Supervisory Authority.

Security and Confidentiality

Actimostra is committed to protecting your personal data and implements appropriate technical and organisational security measures designed to safeguard your information against unauthorised access, disclosure, alteration or destruction.

However, no method of data transmission over the Internet is completely secure. Consequently, while every reasonable effort is made to protect your information, Actimostra cannot guarantee the absolute security of data transmitted through its website.

Actimostra also respects the confidentiality of your information. We do not sell, rent, distribute or otherwise make your personal information commercially available to third parties.

Your personal data will always be processed confidentially and in accordance with this Privacy Policy and applicable data protection legislation.
